TORONTO — Owners of The Real Jerk restaurant are breathing a sigh of relief after being awarded an injunction allowing their Toronto eatery to remain open until the end of 2012 in spite of a notice to vacate issued when the building was sold late last year.
“I’m so happy that it’s turned out,” Ed Pottinger, the restaurant’s owner, told The Globe and Mail. “I knew that I had rights.”
Pottinger took his new landlord, Bill Mandelbaum, to court to fight his eviction notice, and, according to the court ruling, the restaurant will have to pay an additional $5,700 in rent to the courts each month, after March.1.
Mandelnaum, who bought the building last December, was planning to move in a new tenant Feb. 1.
Pottinger is scouting new locations in the area.
